This website is operated by Hiya Art De Vivre, based in Morocco. Throughout the site, the terms “we”, “us” and “our” refer to Hiya Art De Vivre.

By visiting our site and/or purchasing from us, you agree to be bound by these Terms & Conditions, including any additional policies referenced herein.

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of any changes.

2. Products & Craftsmanship

All products sold are handmade, artisanal, and often created using upcycled or repurposed materials, including traditional African textiles.

As a result:

  • Each piece is unique and one-of-a-kind
  • Minor imperfections, irregularities, or variations in color, texture, or stitching are not defects, but rather part of the product’s character and authenticity
  • These characteristics reflect the handmade and sustainable nature of the item

By purchasing, you acknowledge and accept that products are “imperfectly perfect” and may differ slightly from product images.

3. Pricing & Currency

All prices are listed in Moroccan dirhams (MAD) and are subject to change without notice.

Customers are responsible for:

  • Any applicable import duties, taxes, or customs fees imposed by their country
  • Currency conversion fees charged by their payment provider

4. Orders & Payment

We reserve the right to:

  • Refuse or cancel any order at our discretion
  • Limit quantities purchased per customer

In the event of a cancellation initiated by us, a full refund will be issued to the original payment method.

5. Shipping Policy

We ship internationally, including to Europe, North America, and Australia.

  • Shipping times are estimates and may vary due to customs or carrier delays
  • Once an order has been dispatched, we are not responsible for delays beyond our control
  • Customers are responsible for providing accurate shipping details

Important:

  • Shipping costs are non-refundable under any circumstances
  • Lost or delayed shipments must be addressed with the carrier, although we will assist where possible

6. Returns, Exchanges & Store Credit

Due to the nature of our products, we maintain a strict policy:

  • No refunds will be issued
  • No returns for cash reimbursement
  • Approved returns are eligible only for store credit

Conditions for store credit:

  • Request must be made within 10 days of delivery
  • Item must be unused and in original condition
  • Return shipping is the responsibility of the customer

We reserve the right to refuse store credit if the item does not meet these conditions.

7. No Shipping Refunds

Under no circumstances will shipping fees be refunded, including:

  • Returned items
  • Refused deliveries
  • Incorrect address provided by the customer

8. Intellectual Property

All content on this website, including images, branding, text, and designs, is the property of Hiya Art De Vivre and may not be used, reproduced, or distributed without written permission.

9. Customer Conduct & Feedback

We value customer feedback and welcome reviews, suggestions, and communication.

However:

We are not liable for:

  • Indirect, incidental, or consequential damages arising from the use of our products or website
  • Variations in product appearance due to handmade or upcycled nature

Our liability is limited to the purchase price of the product.

These Terms & Conditions are governed by and construed in accordance with the laws of Morocco.

Any disputes arising from the use of this website or purchase of products shall be subject to the exclusive jurisdiction of Moroccan courts.
